| charged by the Brazos River Authority in the event of a drought. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 8502, Special District Local Laws Code, | ||
| is amended by adding Section 8502.0125 to read as follows: | ||
| Sec. 8502.0125. CREDIT AGAINST ACCESS FEE FOR PRIVATE DOCK | ||
| IN EVENT OF DROUGHT. If the authority charges an access fee for a | ||
| private dock located on a lake maintained and operated by the | ||
| authority and the level of the lake is too low because of a drought | ||
| for the dock to provide access to the lake during any part of the | ||
| year for which the fee is charged, the authority shall credit | ||
| against the fee charged for the dock in the following year an amount | ||
| computed by multiplying the amount of the fee charged in the | ||
| preceding year by a fraction representing the part of the preceding | ||
| year in which the level of the lake was too low because of a drought | ||
| for the dock to provide access to the lake. | ||
| SECTION 2. This Act takes effect January 1, 2012. | ||
