| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 555.053, Health and Safety Code, is | ||
| amended by amending Subsection (a) and adding Subsection (c) to | ||
| read as follows: | ||
| (a) The governor shall appoint the independent ombudsman | ||
| for a term of two years expiring February 1 of odd-numbered years. | ||
| (c) A person appointed as independent ombudsman may be | ||
| reappointed. | ||
| SECTION 2. A person serving as the independent ombudsman on | ||
| the effective date of this Act shall serve as the independent | ||
| ombudsman until February 1, 2015, unless otherwise removed by the | ||
| governor. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2013. | ||
