| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 39, Utilities Code, is | ||
| amended by adding Section 39.1516 to read as follows: | ||
| Sec. 39.1516. DISCLOSURE OF ELECTRICITY GENERATION OFFERS. | ||
| (a) An independent organization certified under Section 39.151 | ||
| shall disclose all electricity generation offers in the balancing | ||
| energy market received by the organization. A disclosure under | ||
| this section shall: | ||
| (1) be posted on the organization's Internet website | ||
| not more than two days after the offer is received; and | ||
| (2) include: | ||
| (A) the identity of the generation entity making | ||
| the offer; | ||
| (B) the amount of the offer; and | ||
| (C) the location and period for which the offer | ||
| is made. | ||
| (b) The commission shall adopt rules as necessary to | ||
| implement this section. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
