| wastewater systems and public water systems. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 37, Water Code, is amended by adding | ||
| Section 37.0045 to read as follows: | ||
| Sec. 37.0045. QUALIFICATIONS FOR CERTAIN LICENSES. (a) | ||
| This section applies only to a Class D license for wastewater | ||
| operators or public water system operators. | ||
| (b) In adopting educational attainment standards associated | ||
| with the issuance of a license, the commission by rule shall | ||
| establish a provisional certification program by which a person who | ||
| does not possess a high school diploma or its equivalent may act as | ||
| a provisional operator if the person: | ||
| (1) has completed all commission-required training | ||
| associated with the license; | ||
| (2) has passed any commission-required examinations | ||
| associated with the license; and | ||
| (3) acts under the direct supervision of a license | ||
| holder. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
