| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 38.001, Education Code, is amended by | ||
| adding Subsection (a-1) to read as follows: | ||
| (a-1) Each student shall be fully immunized against | ||
| bacterial meningitis, except as provided by Subsection (c). To | ||
| satisfy the requirement of this subsection, a student must show | ||
| proof of a quadrivalent meningococcal conjugate vaccine and a | ||
| booster dose of that vaccine in accordance with the recommended | ||
| immunization schedule adopted by the Department of State Health | ||
| Services, as well as any additional vaccine recommended for the | ||
| prevention of bacterial meningitis by the federal Centers for | ||
| Disease Control and Prevention. The executive commissioner of the | ||
| Health and Human Services Commission shall adopt rules for the | ||
| implementation of this subsection. | ||
| SECTION 2. Not later than June 1, 2024, the executive | ||
| commissioner of the Health and Human Services Commission shall | ||
| adopt the rules necessary to implement Section 38.001(a-1), | ||
| Education Code, as added by this Act. | ||
| SECTION 3. Section 38.001(a-1), Education Code, as added by | ||
| this Act, applies beginning with the 2024-2025 school year. | ||
| SECTION 4. This Act takes effect September 1, 2023. | ||
