| residential electric customers. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 39.101, Utilities Code, is amended by | ||
| adding Subsection (i) to read as follows: | ||
| (i) Notwithstanding Subsection (h), the commission by rule | ||
| shall require a retail electric provider, power generation company, | ||
| aggregator, or other entity that provides retail electric service | ||
| to make available to a retail customer, regardless of weather or | ||
| time of year: | ||
| (1) a level or average payment plan; and | ||
| (2) a deferred payment plan. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
