| relating to the extent of extraterritorial jurisdiction of certain | ||
| less populous municipalities located on a barrier island. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 42.021, Local Government Code, is | ||
| amended by amending Subsection (b) and adding Subsection (c) to | ||
| read as follows: | ||
| (b) Regardless of Subsection (a), the extraterritorial | ||
| jurisdiction of a municipality is the unincorporated area that is | ||
| contiguous to the corporate boundaries of the municipality and that | ||
| is located: | ||
| (1) within five miles of those boundaries on a [ |
||
| barrier island; or | ||
| (2) within one-half mile of those boundaries off a | ||
| barrier island. | ||
| (c) Subsection (b) applies to a [ |
||
| has: | ||
| (1) a population of 2,000 or more; and | ||
| (2) territory located: | ||
| (A) entirely on a barrier island in the Gulf of | ||
| Mexico; and | ||
| (B) within 30 miles of an international border. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
