| relating to an offense report prepared in the investigation of | ||
| certain criminal cases. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 2, Code of Criminal Procedure, is | ||
| amended by adding Article 2.1397 to read as follows: | ||
| Art. 2.1397. OFFENSE REPORT: RESISTING OR EVADING ARREST. | ||
| An offense report prepared in the investigation of a criminal case | ||
| in which a person is alleged to have resisted or evaded arrest under | ||
| Section 38.03 or 38.04, Penal Code, must state the underlying | ||
| offense for which the person was resisting or evading arrest. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to an offense report prepared on or after the effective date of this | ||
| Act. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
