A BILL TO BE ENTITLED
 
AN ACT
  relating to voting rights in the areas that are included in a
  municipality's annexation plan.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 43, Local Government Code,
  is amended by adding Section 43.0525 to read as follows:
         Sec. 43.0525.  VOTING RIGHTS IN AREAS INCLUDED IN MUNICIPAL
  ANNEXATION PLAN. (a) The qualified voters residing in an area that
  is included in a municipality's annexation plan under Section
  43.052 are entitled to vote in municipal elections regarding the
  election or recall of members of the governing body of the
  municipality, the election or recall of the controller, if the
  office of controller is an elective position of the municipality,
  and the amendment of the municipal charter. The voters may not vote
  in any municipal bond election.
         (b)  On or after the 15th day but before the fifth day before
  the date of the first election held after the date a municipality
  adopts or amends its annexation plan to include an area, the
  municipality shall publish notice in the form of a quarter-page
  advertisement in a newspaper of general circulation in the area
  notifying the residents of the area regarding the eligibility to
  vote in the election and stating the location of all polling places
  for the residents.
         (b-1)  This subsection applies to an area included in a
  municipality's annexation plan before September 1, 2017, for which
  the annexation has not been completed. A municipality subject to
  this subsection, on or after the 15th day but before the fifth day
  before the date of the first election held after September 1, 2017,
  shall publish notice in the form of a quarter-page advertisement in
  a newspaper of general circulation in the area notifying the
  residents of the area regarding the eligibility to vote in the
  election and stating the location of all polling places for the
  residents. This subsection expires September 1, 2019.
         (c)  A resident of an area described by Subsection (a) is not
  eligible to be a candidate for or to be elected to a municipal
  office.
         SECTION 2.  This Act takes effect September 1, 2017.
