A BILL TO BE ENTITLED
AN ACT
relating to the amount of the permit fee for an on-site sewage
disposal system.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 366.058, Health and Safety Code, is
amended by adding Subsection (d) to read as follows:
(d) If the commission delegates to an authorized agent the
authority to establish the amount of a permit fee under Subsection
(a), the amount of the fee established by the authorized agent may
not exceed the amount for a similar permit issued by the commission.
SECTION 2. The change in law made by this Act applies only
to the fee for a permit the application for which is submitted to an
authorized agent under Chapter 366, Health and Safety Code, on or
after the effective date of this Act. The fee for a permit the
application for which is submitted to an authorized agent under
that chapter before the effective date of this Act is governed by
the law in effect at the time the application was submitted, and the
former law is continued in effect for that purpose.
SECTION 3. This Act takes effect September 1, 2011.
