| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 81.0885, Government Code, is amended by | ||
| amending Subsection (a) and adding Subsection (c) to read as | ||
| follows: | ||
| (a) All types of information, proceedings, hearing | ||
| transcripts, and statements presented to the ombudsman are | ||
| confidential and may not be disclosed to any person other than the | ||
| chief disciplinary counsel unless: | ||
| (1) disclosure is ordered by a court; or | ||
| (2) a member of the legislature requests disclosure | ||
| and the complainant consents to disclosure. | ||
| (c) A member of the legislature to whom information, | ||
| proceedings, hearing transcripts, or statements presented to the | ||
| ombudsman are disclosed under Subsection (a) may use the | ||
| information, proceedings, hearing transcripts, or statements only | ||
| in the performance of a power or duty associated with the member's | ||
| office. | ||
| SECTION 2. Section 81.0885, Government Code, as amended by | ||
| this Act, applies only to a disclosure of information, proceedings, | ||
| hearing transcripts, and statements presented to the ombudsman for | ||
| the attorney discipline system of the State Bar of Texas that occurs | ||
| on or after the effective date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
