A BILL TO BE ENTITLED
AN ACT
relating to disclosure by the Texas Commission on Environmental
Quality of information related to emissions events.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 382.0215, Health and Safety Code, is
amended by adding Subsections (b-1) and (e-1) to read as follows:
(b-1) After receiving a report of an emissions event under
Subsection (b)(2), the commission shall provide notice of the event
to officials who represent the area in which the event occurred,
including:
(1) each state senator;
(2) each state representative;
(3) the county commissioners court; and
(4) if applicable, the mayor or other presiding
officer of any affected municipality.
(e-1) The commission shall maintain a list of emissions
events on the commission's Internet website that is easily
accessible by the public and that includes information on emissions
events that have occurred in the preceding 12 weeks. The
information must include:
(1) the name of the regulated entity;
(2) each air contaminant emitted;
(3) the location of the emissions event; and
(4) the date and duration of the event.
SECTION 2. This Act takes effect September 1, 2011.
