| relating to prohibiting the use of state or federal money for the | ||
| purpose of certain instruction at public institutions of higher | ||
| education. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter Z, Chapter 51, Education Code, is | ||
| amended by adding Section 51.979 to read as follows: | ||
| Sec. 51.979. USE OF STATE OR FEDERAL MONEY PROHIBITED FOR | ||
| CERTAIN INSTRUCTION. (a) In this section, "institution of higher | ||
| education" has the meaning assigned by Section 61.003. | ||
| (b) Notwithstanding any other law, an institution of higher | ||
| education may not use appropriated state or federal money to offer a | ||
| course, component of a course, unit of study, or other instruction | ||
| that directs or otherwise compels a student to personally affirm, | ||
| adopt, or adhere to the idea that: | ||
| (1) any race, sex, ethnicity, religion, color, or | ||
| national origin is inherently superior or inferior to another race, | ||
| sex, ethnicity, religion, color, or national origin; | ||
| (2) an individual should be discriminated against or | ||
| receive adverse treatment solely or partly because of the | ||
| individual's race, sex, ethnicity, religion, color, or national | ||
| origin; or | ||
| (3) an individual, by virtue of the individual's race, | ||
| sex, ethnicity, religion, color, or national origin, is inherently | ||
| responsible for actions committed in the past by other members of | ||
| the same race, sex, ethnicity, religion, color, or national origin. | ||
| SECTION 2. This Act applies beginning with the 2022 spring | ||
| semester. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect on the 91st day after the last day of the | ||
| legislative session. | ||
