A BILL TO BE ENTITLED
AN ACT
relating to the composition of the districts for the election of
members of the State Board of Education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
ARTICLE I
SECTION 1. (a) The members of the State Board of Education
are elected from the districts described by Article II of this Act.
(b) One member is elected from each district established by
this Act.
(c) The districts established by this Act are identified as
PLANE100 on the redistricting computer system operated by the Texas
Legislative Council.
(d) For purposes of Section 7.104, Education Code, this Act
constitutes a decennial reapportionment.
ARTICLE II
SECTION 1. District 1 is composed of Bandera, Brewster,
Crane, Crockett, Culberson, Dimmit, Edwards, El Paso, Hudspeth,
Irion, Jeff Davis, Jim Hogg, Kerr, Kimble, Kinney, La Salle,
Loving, Mason, Maverick, Menard, Midland, Pecos, Presidio, Reagan,
Real, Reeves, Schleicher, Starr, Sutton, Terrell, Upton, Uvalde,
Val Verde, Ward, Webb, Winkler, Zapata and Zavala Counties.
SECTION 2. District 2 is composed of Aransas, Calhoun,

Crosby, Dallam, Dawson, Deaf Smith, Dickens, Donley, Ector, Fisher,
Floyd, Foard, Gaines, Garza, Glasscock, Gray, Hale, Hall, Hansford,
Hardeman, Hartley, Haskell, Hemphill, Hockley, Howard, Hutchinson,
Jones, Kent, King, Knox, Lamb, Lipscomb, Lubbock, Lynn, McCulloch,
Martin, Mitchell, Moore, Motley, Nolan, Ochiltree, Oldham, Parmer,
Potter, Randall, Roberts, Runnels, San Saba, Scurry, Shackelford,
Sherman, Sterling, Stonewall, Swisher, Taylor, Terry,
Throckmorton, Tom Green, Wheeler, Wilbarger and Yoakum Counties.
ARTICLE III
SECTION 1. In this Act, "tract," "block group," and "block"
mean the geographic areas identified by those terms on the 2000
Census TIGER/Line File, prepared by the federal Bureau of the
Census for the Twenty-second Decennial Census of the United States,
enumerated as of April 1, 2000.
SECTION 2. It is the intention of the Texas Legislature
that, if any county, tract, block group, block, or other geographic
area has erroneously been left out of this Act, a court reviewing
this Act should include that area in the appropriate district in
accordance with the intent of the legislature, using any available
evidence of that intent, including evidence such as that used by the
Supreme Court of Texas in Smith v. Patterson, 111 Tex. 535, 242 S.W.
749 (1922).
SECTION 3. (a) Section 7.101(a), Education Code, is
amended to read as follows:
(a) The State Board of Education is composed of 15 members
elected from districts. [Each district from which a board member is
elected is composed as provided by former Sections 11.2101(b)-(t),
as enacted by Chapter 2, Acts of the 72nd Legislature, 2nd Called
Session, 1991.]
(b) This Act supersedes all previous enactments or orders
adopting districts for the State Board of Education. All previous
acts of the legislature adopting districts for the State Board of
Education are repealed.
SECTION 4. The districts set out in Article II of this Act
apply to the election of the members of the State Board of Education
beginning with the primary and general elections in 2012 for
members of the board in 2013. This Act does not affect the
membership or districts of the board before January 1, 2013.
SECTION 5. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect on the 91st day after the last day of the
legislative session.
