| line of duty. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 225.021(c), Transportation Code, is | ||
| amended to read as follows: | ||
| (c) Except as provided by Section 225.0215, the [ |
||
| department may not design, construct, or erect a marker under this | ||
| subchapter unless a grant or donation of funds is made to the | ||
| department to cover the cost of the design, construction, and | ||
| erection of the marker. | ||
| SECTION 2. Subchapter B, Chapter 225, Transportation Code, | ||
| is amended by adding Section 225.0215 to read as follows: | ||
| Sec. 225.0215. MEMORIAL MARKERS FOR CERTAIN OFFICERS KILLED | ||
| IN LINE OF DUTY. (a) This section applies only to a marker required | ||
| under this subchapter designating a part of the highway system, | ||
| including a bridge or street, for an individual killed in the line | ||
| of duty who was: | ||
| (1) a law enforcement officer or peace officer for | ||
| this state or a political subdivision of this state under Article | ||
| 2A.001, Code of Criminal Procedure; or | ||
| (2) a federal law enforcement officer or special agent | ||
| performing duties in this state, including those officers under | ||
| Article 2A.002, Code of Criminal Procedure. | ||
| (b) Notwithstanding Section 225.021(c), the department may | ||
| design, construct, or erect a marker to which this section applies | ||
| using: | ||
| (1) money appropriated from the general revenue fund | ||
| to the department for those purposes; and | ||
| (2) gifts, grants, and donations accepted by the | ||
| department for those purposes. | ||
| SECTION 3. This Act takes effect September 1, 2025. | ||
