| relating to the prioritization of natural gas deliveries to certain | ||
| electric power generation units. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 121, Utilities Code, is | ||
| amended by adding Section 121.159 to read as follows: | ||
| Sec. 121.159. PRIORITY OF NATURAL GAS DELIVERY DURING | ||
| CURTAILMENT EVENT. (a) In this section, "human needs customers" | ||
| includes: | ||
| (1) residences, hospitals, water and wastewater | ||
| facilities, and police, fire, and military and civil defense | ||
| facilities; | ||
| (2) other locations where people may congregate in an | ||
| emergency; | ||
| (3) small commercial customers that cannot | ||
| practicably be curtailed without curtailing human needs; | ||
| (4) natural-gas-fired electric generation facilities; | ||
| and | ||
| (5) any other customers identified by rule by the | ||
| railroad commission. | ||
| (b) A gas utility that determines that the utility's ability | ||
| to deliver natural gas may become inadequate to support continuous | ||
| service to customers on the utility's intrastate system and that | ||
| reduces intrastate deliveries to one or more customers shall | ||
| prioritize natural gas deliveries to natural-gas-fired electric | ||
| generation facilities at the same level as natural gas deliveries | ||
| to other human needs customers and local distribution systems that | ||
| serve those human needs customers. | ||
| SECTION 2. This Act takes effect September 1, 2025. | ||
