relating to the powers and duties of a county or municipality to | ||
impose taxes on behalf of a navigation district. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 62.160, Water Code, is amended to read as | ||
follows: | ||
Sec. 62.160. MAINTENANCE TAX. (a) The commissioners | ||
courts of the respective counties inside each district may, and on | ||
request by the district, shall, levy and have assessed and | ||
collected for the maintenance, operation, and upkeep of the | ||
district and the improvements constructed by the district an annual | ||
tax not to exceed 10 cents on the $100 valuation on all property | ||
inside the district. | ||
(b) The governing bodies of the respective municipalities | ||
inside each district may, and on request of the district, shall, | ||
levy and have assessed and collected for the maintenance, | ||
operation, and upkeep of the district and the improvements | ||
constructed by the district an annual tax not to exceed 10 cents on | ||
the $100 valuation on all property inside the district. | ||
(c) The district on behalf of which a tax is collected under | ||
Subsections (a) and (b) shall pay the costs of levying, assessing, | ||
and collecting the tax. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2017. |
