| impose taxes on behalf of a navigation district. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 62.160, Water Code, is amended to read as | ||
| follows: | ||
| Sec. 62.160. MAINTENANCE TAX. (a) The commissioners | ||
| courts of the respective counties inside each district may, and on | ||
| request by the district, shall, levy and have assessed and | ||
| collected for the maintenance, operation, and upkeep of the | ||
| district and the improvements constructed by the district an annual | ||
| tax not to exceed 10 cents on the $100 valuation on all property | ||
| inside the district. | ||
| (b) The governing bodies of the respective municipalities | ||
| inside each district may, and on request of the district, shall, | ||
| levy and have assessed and collected for the maintenance, | ||
| operation, and upkeep of the district and the improvements | ||
| constructed by the district an annual tax not to exceed 10 cents on | ||
| the $100 valuation on all property inside the district. | ||
| (c) The district on behalf of which a tax is collected under | ||
| Subsections (a) and (b) shall pay the costs of levying, assessing, | ||
| and collecting the tax. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
