| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 775.301, Health and Safety Code, is | ||
| amended to read as follows: | ||
| Sec. 775.301. DEFINITION. In this subchapter, | ||
| "commissioners court" means the commissioners court of a county | ||
| described by Section 775.302 [ |

| SECTION 2. Section 775.302(a), Health and Safety Code, is | ||
| amended to read as follows: | ||
| (a) This subchapter applies only to a district with an | ||
| appointed [ |
||
| emergency services commissioners located wholly in a county that: | ||
| (1) borders the United Mexican States and has a | ||
| population of more than 800,000; or | ||
| (2) contains a reservoir operated by a river authority | ||
| and has a population of at least 60,000 and not more than 65,000 | ||

| SECTION 3. This Act takes effect September 1, 2023. | ||
