| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 1701.302, Occupations Code, is amended | ||
| by amending Subsection (a) and adding Subsection (a-1) to read as | ||
| follows: | ||
| (a) Except as provided by Subsection (a-1), an [ |
||
| including a sheriff, elected under the Texas Constitution or a | ||
| statute or appointed to fill a vacancy in an elective office must | ||
| obtain a license from the commission not later than [ |
||
| (a-1) An officer described in Subsection (a) must obtain a | ||
| license from the commission not later than the second anniversary | ||
| of the date the officer takes office if: | ||
| (1) the officer serves a county with fewer than 50,000 | ||
| people; or | ||
| (2) the commissioner's court of the county served by | ||
| the officer votes unanimously to waive the requirement of | ||
| Subsection (a). | ||
| SECTION 2. An officer subject to Subsection (a), Section | ||
| 1701.302, Occupations Code, as amended by this Act, who holds | ||
| office on the effective date of this Act must obtain a license from | ||
| the Texas Commission on Law Enforcement by September 1, 2022. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
