A BILL TO BE ENTITLED
 
AN ACT
  relating to qualifications for sheriffs in certain counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1701.302, Occupations Code, is amended
  by amending Subsection (a) and adding Subsection (a-1) to read as
  follows:
         (a)  Except as provided by Subsection (a-1), an [An] officer,
  including a sheriff, elected under the Texas Constitution or a
  statute or appointed to fill a vacancy in an elective office must
  obtain a license from the commission not later than [the second
  anniversary of] the date the officer takes office.
         (a-1)  An officer described in Subsection (a) must obtain a
  license from the commission not later than the second anniversary
  of the date the officer takes office if:
               (1)  the officer serves a county with fewer than 50,000
  people; or
               (2)  the commissioner's court of the county served by
  the officer votes unanimously to waive the requirement of
  Subsection (a).
         SECTION 2.  An officer subject to Subsection (a), Section
  1701.302, Occupations Code, as amended by this Act, who holds
  office on the effective date of this Act must obtain a license from
  the Texas Commission on Law Enforcement by September 1, 2022.
         SECTION 3.  This Act takes effect September 1, 2021.
