A BILL TO BE ENTITLED
 
AN ACT
  relating to fees of office payable to directors of certain
  municipal management districts.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 375.069, Local Government Code, is
  amended to read as follows:
         Sec. 375.069.  [BOARD POSITION NOT] CIVIL OFFICE OF
  EMOLUMENT. (a) Subject to Subsection (b), a [A] position on the
  board may not be construed to be a civil office of emolument for any
  purpose, including those purposes described by [Article XVI,]
  Section 40, Article XVI, [of the] Texas Constitution.
         (b)  The board by resolution may declare that a position on
  the board is a civil office of emolument under Section 40, Article
  XVI, Texas Constitution, if the governing board of the municipality
  in which the district is located consents by resolution or
  ordinance.
         SECTION 2.  Section 375.070, Local Government Code, is
  amended to read as follows:
         Sec. 375.070.  COMPENSATION OF DIRECTORS; REIMBURSEMENT OF
  EXPENSES. (a) A director is not entitled to compensation for
  service on the board but is entitled to be reimbursed for necessary
  expenses incurred in carrying out the duties and responsibilities
  of a director.
         (b)  Notwithstanding Subsection (a), a director whose
  position is made a civil office of emolument under Section
  375.069(b) is entitled to receive fees of office and reimbursement
  of eligible expenses in the manner provided by Section 49.060,
  Water Code. 
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
