| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter I, Chapter 16, Water Code, is amended | ||
| by adding Section 16.3151 to read as follows: | ||
| Sec. 16.3151. RIGHT TO ENTER PROPERTY IN FLOOD-PRONE AREAS. | ||
| A political subdivision is authorized to enter and inspect property | ||
| in a flood-prone area at any time to determine if the property is | ||
| being maintained in compliance with law or with the ordinances, | ||
| orders, or rules of the political subdivision that enters the | ||
| property. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
