| underutilized businesses under certain state purchasing contracts. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 2161.253(d), Government Code, is amended | ||
| to read as follows: | ||
| (d) If a state agency determination is made that the | ||
| contractor failed to implement the subcontracting plan in good | ||
| faith, the agency, in addition to any other remedies, may: | ||
| (1) consider the contractor's failure to implement the | ||
| subcontracting plan as substandard performance under the contract | ||
| when evaluating the contractor's bids in the award of future agency | ||
| contracts; or | ||
| (2) bar the contractor from further contracting | ||
| opportunities with the agency. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
