A BILL TO BE ENTITLED
 
AN ACT
  relating to subcontracting opportunities for historically
  underutilized businesses under certain state purchasing contracts.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2161.253(d), Government Code, is amended
  to read as follows:
         (d)  If a state agency determination is made that the
  contractor failed to implement the subcontracting plan in good
  faith, the agency, in addition to any other remedies, may:
               (1)  consider the contractor's failure to implement the
  subcontracting plan as substandard performance under the contract
  when evaluating the contractor's bids in the award of future agency
  contracts; or
               (2)  bar the contractor from further contracting
  opportunities with the agency.
         SECTION 2.  This Act takes effect September 1, 2011.
