school; providing a penalty. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 7, Education Code, is | ||
amended by adding Section 7.115 to read as follows: | ||
Sec. 7.115. PROHIBITION ON CERTAIN EMPLOYMENT. (a) A | ||
member of the State Board of Education, or a former member of the | ||
State Board of Education before the second anniversary of the date | ||
on which the person last served as a member, may not be employed by | ||
an open-enrollment charter school or any charitable organization | ||
affiliated with an open-enrollment charter school if the charter | ||
for the open-enrollment charter school was granted while the member | ||
or former member served on the board unless the member or former | ||
member abstained from the vote that granted the charter for the | ||
open-enrollment charter school. | ||
(b) A person who violates Subsection (a) commits an offense. | ||
An offense under this subsection is a Class A misdemeanor. | ||
SECTION 2. Section 7.115, Education Code, as added by this | ||
Act, applies only to employment that begins on or after the | ||
effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2013. | ||
