A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirement by a municipality of a license or permit
  to occupy or lease a dwelling unit.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 214, Local Government
  Code, is amended by adding Section 214.907 to read as follows:
         Sec. 214.907.  LIMITATION ON MUNICIPAL REQUIREMENTS OF
  LICENSE OR PERMIT TO OCCUPY DWELLING UNIT. A municipality may not
  require a tenant to acquire a license or permit issued by the
  municipality as a condition for occupying or leasing an individual
  dwelling unit in a single-family, duplex, or multifamily structure.
  This section does not prohibit a municipality from requiring a
  license or permit relating to the nonresidential use or the
  condition of a dwelling unit.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
