| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter Z, Chapter 214, Local Government | ||
| Code, is amended by adding Section 214.907 to read as follows: | ||
| Sec. 214.907. LIMITATION ON MUNICIPAL REQUIREMENTS OF | ||
| LICENSE OR PERMIT TO OCCUPY DWELLING UNIT. A municipality may not | ||
| require a tenant to acquire a license or permit issued by the | ||
| municipality as a condition for occupying or leasing an individual | ||
| dwelling unit in a single-family, duplex, or multifamily structure. | ||
| This section does not prohibit a municipality from requiring a | ||
| license or permit relating to the nonresidential use or the | ||
| condition of a dwelling unit. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
