relating to an allotment for day placement programs under the | ||
Foundation School Program. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter G, Chapter 48, Education Code, is | ||
amended by adding Section 48.307 to read as follows: | ||
Sec. 48.307. DAY PLACEMENT PROGRAM FUNDING. (a) For each | ||
qualifying day placement program that a regional education service | ||
center makes available in partnership with a school district, | ||
open-enrollment charter school, or shared services arrangement, | ||
the center is entitled to an allotment of: | ||
(1) $250,000 for the first year of the program's | ||
operation; and | ||
(2) $150,000 for each year of the program's operation | ||
after the first year. | ||
(b) A day placement program qualifies for purposes of | ||
Subsection (a) if: | ||
(1) the program complies with commissioner rules | ||
regarding contracts for the placement of students receiving special | ||
education services in a day placement program; | ||
(2) the program offers services to students who are | ||
enrolled at any school district or open-enrollment charter school | ||
in the county in which the program is offered, unless the | ||
commissioner by rule waives or modifies the requirement under this | ||
subdivision for the program to serve all students in a county; and | ||
(3) the agency has designated the program for service | ||
in the county in which the program is offered. | ||
SECTION 2. This Act takes effect September 1, 2023. |
