| relating to an allotment for day placement programs under the | ||
| Foundation School Program. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter G, Chapter 48, Education Code, is | ||
| amended by adding Section 48.307 to read as follows: | ||
| Sec. 48.307. DAY PLACEMENT PROGRAM FUNDING. (a) For each | ||
| qualifying day placement program that a regional education service | ||
| center makes available in partnership with a school district, | ||
| open-enrollment charter school, or shared services arrangement, | ||
| the center is entitled to an allotment of: | ||
| (1) $250,000 for the first year of the program's | ||
| operation; and | ||
| (2) $150,000 for each year of the program's operation | ||
| after the first year. | ||
| (b) A day placement program qualifies for purposes of | ||
| Subsection (a) if: | ||
| (1) the program complies with commissioner rules | ||
| regarding contracts for the placement of students receiving special | ||
| education services in a day placement program; | ||
| (2) the program offers services to students who are | ||
| enrolled at any school district or open-enrollment charter school | ||
| in the county in which the program is offered, unless the | ||
| commissioner by rule waives or modifies the requirement under this | ||
| subdivision for the program to serve all students in a county; and | ||
| (3) the agency has designated the program for service | ||
| in the county in which the program is offered. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
