| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 248A.152, Health and Safety Code, is | ||
| amended by amending Subsection (c) and adding Subsection (d) to | ||
| read as follows: | ||
| (c) A center's building must be suitable for use as a | ||
| prescribed pediatric extended care center and must provide a | ||
| minimum of 60 square feet of space for each child, exclusive of a | ||
| space that is: | ||
| (1) a kitchen; | ||
| (2) a bathroom; | ||
| (3) a storage area; | ||
| (4) a stairway; and | ||
| (5) an unfinished basement or attic. | ||
| (d) The maximum patient capacity at a center may not exceed | ||
| 100 [ |

| SECTION 2. Section 248A.152(c), Health and Safety Code, as | ||
| amended by this Act, does not apply to a prescribed pediatric | ||
| extended care center that has a maximum patient capacity of 60 or | ||
| fewer patients and that was operating immediately before the | ||
| effective date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
