A BILL TO BE ENTITLED
 
AN ACT
  relating to a building used as a prescribed pediatric extended care
  center.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 248A.152, Health and Safety Code, is
  amended by amending Subsection (c) and adding Subsection (d) to
  read as follows:
         (c)  A center's building must be suitable for use as a
  prescribed pediatric extended care center and must provide a
  minimum of 60 square feet of space for each child, exclusive of a
  space that is:
               (1)  a kitchen;
               (2)  a bathroom;
               (3)  a storage area;
               (4)  a stairway; and
               (5)  an unfinished basement or attic.
         (d)  The maximum patient capacity at a center may not exceed
  100 [60].
         SECTION 2.  Section 248A.152(c), Health and Safety Code, as
  amended by this Act, does not apply to a prescribed pediatric
  extended care center that has a maximum patient capacity of 60 or
  fewer patients and that was operating immediately before the
  effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2017.
