A BILL TO BE ENTITLED
 
AN ACT
  relating to penalties imposed on a holder of an alcoholic beverage
  license or permit.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11.641, Alcoholic Beverage Code, is
  amended by adding Subsection (d) to read as follows:
         (d)  Notwithstanding (c), the commission may seek to impose
  an administrative sanction against a permit or license holder when
  the administrative sanction arises from the same facts or
  circumstances as a criminal prosecution, so long as the sanction is
  not dependent on a finding of guilt for the commission of a criminal
  offense.
         SECTION 2.  Section 11.641, Alcoholic Beverage Code, as
  amended by this Act, applies only to the imposition of an
  administrative sanction for a violation that occurs on or after the
  effective date of this Act.  The imposition of a civil penalty,
  including cancellation of a permit, for a violation that occurs
  before the effective date of this Act is governed by the law in
  effect immediately before the effective date of this Act, and that
  law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2017.
