A BILL TO BE ENTITLED
AN ACT
relating to the use of seclusion by community centers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 534, Health and Safety
Code, is amended by adding Section 534.0156 to read as follows:
Sec. 534.0156. USE OF SECLUSION. (a) For purposes of this
section, "seclusion" has the meaning assigned by Section 322.001,
Health and Safety Code.
(b) The executive commissioner of the Health and Human
Services Commission shall adopt rules that allow a community center
to use seclusion during an emergency behavioral intervention on a
person who is receiving crisis intake services from the center. The
rules must conform to rules adopted under Chapter 322 to the extent
practicable.
SECTION 2. This Act takes effect September 1, 2011.
