| promotion and retention policies. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 28, Education Code, is | ||
| amended by adding Section 28.0217 to read as follows: | ||
| Sec. 28.0217. NOTIFICATION OF PROMOTION AND RETENTION | ||
| POLICIES. A school district shall include with the written notice | ||
| required under Section 28.022(a)(2) notice of the district's | ||
| promotion and retention policies. The notice must include: | ||
| (1) the requirements for student advancement under | ||
| Sections 28.021 and 28.0211; and | ||
| (2) an explanation of any change made to the district's | ||
| promotion and retention policies since the district's requirements | ||
| for advancement were made public by the start of the school year | ||
| under Section 28.021(d). | ||
| SECTION 2. This Act applies beginning with the 2013-2014 | ||
| school year. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2013. | ||
