A BILL TO BE ENTITLED
 
AN ACT
  relating to the use of peace officers as attendance officers for
  school districts and open-enrollment charter schools.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 25.090, Education Code, is amended by
  adding Subsections (b-1) and amending Subsection (c) to read as
  follows:
         (b-1)  In this section, "peace officer" includes a
  constable.
         (c)  For services performed under this section by a peace
  officer, additional [Additional] compensation shall [may not] be
  paid from the funds of the county, independent school district, or
  open-enrollment charter school at a rate commensurate with the
  regular wages of the peace officer [for services performed under
  this section].
         SECTION 2.  This Act takes effect September 1, 2021.
