A BILL TO BE ENTITLED
 
AN ACT
  relating to the prohibition of tolls on a portion of Interstate
  Highway 635.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Subchapter B, Chapter 372,
  Transportation Code, is amended to read as follows:
  SUBCHAPTER B.  TOLL PROJECT OPERATION; LIMITATION ON TOLL
  COLLECTION
         SECTION 2.  Subchapter B, Chapter 372, Transportation Code,
  is amended by adding Section 372.059 to read as follows:
         Sec. 372.059.  TOLLS PROHIBITED ON PORTION OF INTERSTATE
  HIGHWAY 635. The department may not charge a toll, either directly
  or indirectly through an agreement with another toll project
  entity, on the portion of Interstate Highway 635 between its
  intersection with Interstate Highway 30 and its intersection with
  U.S. Highway 75.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
