A BILL TO BE ENTITLED
AN ACT
relating to certain investigations conducted by the Texas Alcoholic
Beverage Commission.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 5.36, Alcoholic Beverage Code, is
amended by adding Subsection (b) to read as follows:
(b) When conducting an investigation relating to an
accident that resulted from an individual operating a motor vehicle
while under the influence of alcohol, the commission shall
investigate each licensed or permitted establishment where the
individual obtained alcoholic beverages during the 24 hours
preceding the accident to determine whether the establishment
violated this code in connection with selling or serving an
alcoholic beverage to the individual.
SECTION 2. This Act takes effect September 1, 2011.
