| relating to a prohibition on local solid waste management | ||
| regulations that are inconsistent with a permit or regulations of | ||
| the Texas Commission on Environmental Quality. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 361.096, Health and Safety Code, is | ||
| amended by amending Subsection (a) and adding Subsection (c) to | ||
| read as follows: | ||
| (a) Except as provided by Subsection (c) and as otherwise | ||
| specifically provided by this chapter, this subchapter does not | ||
| limit the powers and duties of a local government or other political | ||
| subdivision of the state as conferred by this or other law. | ||
| (c) Notwithstanding any other law, a local government or | ||
| other political subdivision of the state may not adopt a rule or | ||
| ordinance that conflicts with or is otherwise inconsistent with the | ||
| requirements for solid waste management facilities as specified by | ||
| the rules of the commission or by a permit issued by the commission. | ||
| SECTION 2. This Act takes effect September 1, 2015. | ||
