relating to the taking of wildlife by a person on the person's | ||
property for purposes of disease diagnosis, management, or | ||
prevention. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 12.013, Parks and Wildlife Code, is | ||
amended by adding Subsections (c) and (d) to read as follows: | ||
(c) A person who is not a department employee, or the | ||
person's agent who is not a department employee, may take wildlife | ||
on the person's property if the person: | ||
(1) has written authorization from the department; and | ||
(2) is participating: | ||
(A) under the supervision of a department | ||
employee; and | ||
(B) in a program or event conducted for the | ||
diagnosis, management, or prevention of a disease in wildlife, as | ||
designated by the director. | ||
(d) The commission may adopt rules to implement this | ||
section. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
