| certain school district employees or officials and a prohibition on | ||
| certain school districts from entering into certain contracts. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 44, Education Code, is | ||
| amended by adding Section 44.0314 to read as follows: | ||
| Sec. 44.0314. APPLICABILITY OF REQUIREMENTS AND | ||
| PROHIBITIONS REGARDING CONFLICTS OF INTEREST. (a) Except as | ||
| provided by Subsection (b), Section 2261.252, Government Code, | ||
| applies to a school district as if the district were a state agency, | ||
| and to a district employee or official as if the employee or | ||
| official were a state agency employee or official, to the extent | ||
| that that section does not conflict with this code. | ||
| (b) This section does not apply to a school district, or to | ||
| an employee or official of the district, that is classified by the | ||
| agency as: | ||
| (1) rural; | ||
| (2) non-metropolitan: stable; or | ||
| (3) independent town. | ||
| SECTION 2. Section 44.0314, Education Code, as added by | ||
| this Act, applies only to a contract entered into on or after the | ||
| effective date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
