A BILL TO BE ENTITLED
AN ACT
relating to a study of and report on public and private
out-of-school time programs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter Z, Chapter 29, Education Code, is
amended by adding Section 29.9181 to read as follows:
Sec. 29.9181. STUDY OF AND REPORT ON PUBLIC AND PRIVATE
OUT-OF-SCHOOL TIME PROGRAMS. (a) In this section, "out-of-school
time program" means a community-based or school-based program
designed to provide a wide range of services and activities,
including counseling, mentoring, career exploration, academic
assistance, and sports and recreation, to children and youth before
and after school and on weekends.
(b) The agency shall conduct a study of public and private
out-of-school time programs in this state to determine:
(1) the number of children served by a public or
private out-of-school time program;
(2) the number and location of children who could
benefit from but are not served by an out-of-school time program;
(3) federal, state, and local funding sources and
amounts that currently support out-of-school time programs;
(4) the extent of any effect of out-of-school time
programs on reducing the dropout rate and improving academic
performance; and
(5) the best practices for out-of-school time programs
to achieve a reduction in the dropout rate and improvement in
academic performance.
(c) The agency may solicit and accept a gift, grant, or
donation from any source, including a foundation or private entity,
for the study. The study may be conducted only if sufficient funds
are available under this subsection for that purpose.
(d) Not later than December 1, 2012, the agency shall submit
to the governor, the lieutenant governor, the speaker of the house
of representatives, and the presiding officer of each legislative
standing committee with primary jurisdiction over primary and
secondary education a written report that contains the results of
the study.
(e) This section expires December 31, 2012.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
