| relating to the coordination of state and federal standards and | ||
| reporting requirements related to the receipt of certain federal | ||
| money. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 403, Government Code, is | ||
| amended by adding Section 403.0123 to read as follows: | ||
| Sec. 403.0123. COORDINATION OF CERTAIN STANDARDS AND | ||
| REPORTING REQUIREMENTS. (a) In this section: | ||
| (1) "One-time payment" means a one-time allocation of | ||
| federal money, including stimulus money, to a state agency | ||
| appropriated by legislation other than an annual federal | ||
| appropriations act. | ||
| (2) "State agency" means a department, commission, | ||
| board, office, or other agency in the executive or legislative | ||
| branch of state government created by the constitution or a statute | ||
| of this state, including an institution of higher education as | ||
| defined by Section 61.003, Education Code. | ||
| (b) If at least 10 state agencies receive a combined total | ||
| of at least $1 billion in one-time payments in a state fiscal year, | ||
| the comptroller shall establish standards and reporting | ||
| requirements, including performance benchmarks, required of each | ||
| state agency that receives a one-time payment. The comptroller | ||
| shall ensure that the standards and reporting requirements conform | ||
| to any federal standards and reporting requirements related to the | ||
| one-time payments. To the greatest extent practicable, the | ||
| comptroller shall eliminate or suspend a state reporting | ||
| requirement that is duplicative or unnecessary in light of the | ||
| standards and reporting requirements established under this | ||
| section. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
