A BILL TO BE ENTITLED
AN ACT
relating to the provision of legal services by a guardian in
connection with a guardianship.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subpart F, Part 4, Chapter XIII, Texas Probate
Code, is amended by adding Section 773A to read as follows:
Sec. 773A. GUARDIAN PROVIDING LEGAL SERVICES FOR WARD
PROHIBITED. An attorney who serves as guardian may not provide
legal services in connection with the guardianship.
SECTION 2. Section 665D, Texas Probate Code, is repealed.
SECTION 3. The changes in law made by this Act apply to a
guardianship created before, on, or after the effective date of
this Act.
SECTION 4. This Act takes effect September 1, 2011.
