| WHEREAS, Every day on Texas highways, contract carriers | ||
| transport railroad personnel to and from trains and in between | ||
| terminals, traveling some 20 million miles each year; and | ||
| WHEREAS, Justin Little was working as a railroad conductor on | ||
| August 14, 2005, when the contract carrier transporting him and his | ||
| fellow employees ran off the road and hit a tree, fatally injuring | ||
| one person and critically injuring Mr. Little and his fellow | ||
| railroad crew member; and | ||
| WHEREAS, Toxicological testing of the vehicle driver from | ||
| that day showed him to have methamphetamine in his bloodstream; and | ||
| WHEREAS, Due to the injuries sustained in the accident, Mr. | ||
| Little continues to be dependent on others for his care; and | ||
| WHEREAS, This tragic event was the impetus for the 81st Texas | ||
| Legislature to change Texas statutes regarding contract carrier | ||
| regulations, vastly improving the safety of railroad crews being | ||
| transported by contract carrier; Senate Bill 481, which was passed | ||
| on May 12, 2009, and signed into law by the governor on May 23 of | ||
| that same year, was the legislative measure by which these | ||
| important safety improvements were made; now, therefore, be it | ||
| RESOLVED, That the House of Representatives of the 82nd Texas | ||
| Legislature hereby recognize Senate Bill 481, 81st Texas | ||
| Legislature, Regular Session, 2009, as the Justin Little Rail Crew | ||
| Safe Transportation Act. | ||
