| BE IT RESOLVED by the House of Representatives of the State of | ||
| Texas, 88th Legislature, Regular Session, 2023, That House Rule 13, | ||
| Section 9(a), be suspended in part as provided by House Rule 13, | ||
| Section 9(f), to enable the conference committee appointed to | ||
| resolve the differences on Senate Bill 12 (the authority to | ||
| regulate sexually oriented performances and to restricting those | ||
| performances on the premises of a commercial enterprise, on public | ||
| property, or in the presence of an individual younger than 18 years | ||
| of age; authorizing a civil penalty; creating a criminal offense) | ||
| to consider and take action on the following matter: | ||
| House Rule 13, Section 9(a)(4), is suspended to permit the | ||
| committee to add text on a matter not included in either the house | ||
| or senate version of the bill in proposed SECTION 3 of the bill, by | ||
| adding Section 43.28(a)(1)(E), Penal Code, to read as follows: | ||
| (E) the exhibition of sexual gesticulations | ||
| using accessories or prosthetics that exaggerate male or female | ||
| sexual characteristics | ||
| Explanation: The change is necessary to add additional | ||
| conduct to the definition of sexual conduct. | ||
