R E S O L U T I O N
         BE IT RESOLVED by the House of Representatives of the State of
  Texas, 88th Legislature, Regular Session, 2023, That House Rule 13,
  Section 9(a), be suspended in part as provided by House Rule 13,
  Section 9(f), to enable the conference committee appointed to
  resolve the differences on Senate Bill 12 (the authority to
  regulate sexually oriented performances and to restricting those
  performances on the premises of a commercial enterprise, on public
  property, or in the presence of an individual younger than 18 years
  of age; authorizing a civil penalty; creating a criminal offense)
  to consider and take action on the following matter:
         House Rule 13, Section 9(a)(4), is suspended to permit the
  committee to add text on a matter not included in either the house
  or senate version of the bill in proposed SECTION 3 of the bill, by
  adding Section 43.28(a)(1)(E), Penal Code, to read as follows:
                     (E)  the exhibition of sexual gesticulations
  using accessories or prosthetics that exaggerate male or female
  sexual characteristics
         Explanation: The change is necessary to add additional
  conduct to the definition of sexual conduct.
