BE IT RESOLVED by the House of Representatives of the State of | ||
Texas, 88th Legislature, Regular Session, 2023, That House Rule 13, | ||
Section 9(a), be suspended in part as provided by House Rule 13, | ||
Section 9(f), to enable the conference committee appointed to | ||
resolve the differences on Senate Bill 12 (the authority to | ||
regulate sexually oriented performances and to restricting those | ||
performances on the premises of a commercial enterprise, on public | ||
property, or in the presence of an individual younger than 18 years | ||
of age; authorizing a civil penalty; creating a criminal offense) | ||
to consider and take action on the following matter: | ||
House Rule 13, Section 9(a)(4), is suspended to permit the | ||
committee to add text on a matter not included in either the house | ||
or senate version of the bill in proposed SECTION 3 of the bill, by | ||
adding Section 43.28(a)(1)(E), Penal Code, to read as follows: | ||
(E) the exhibition of sexual gesticulations | ||
using accessories or prosthetics that exaggerate male or female | ||
sexual characteristics | ||
Explanation: The change is necessary to add additional | ||
conduct to the definition of sexual conduct. | ||
