| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 20, Article XVI, Texas Constitution, is | ||
| amended by adding Subsections (e) and (f) to read as follows: | ||
| (e) A person who sells or is authorized to sell distilled | ||
| spirits to consumers for off-premises consumption may not: | ||
| (1) knowingly utilize or employ any person younger | ||
| than the legal drinking age to work on a premises where distilled | ||
| spirits are stored, sold, or transported; or | ||
| (2) knowingly allow a person younger than the legal | ||
| drinking age to enter or remain upon a premises where distilled | ||
| spirits are stored, sold, or transported unless that person is | ||
| accompanied at all times by that person's parent, legal guardian, | ||
| or spouse who is of the legal drinking age. | ||
| (f) Subsection (e) does not prohibit the use or employment | ||
| of a person by the person's parent, legal guardian, or spouse who is | ||
| of the legal drinking age to work in a business owned by the parent, | ||
| legal guardian, or spouse or the presence of a person on the | ||
| premises of a business owned by the person's parent, legal | ||
| guardian, or spouse who is of the legal drinking age. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 5, 2013. | ||
| The ballot shall be printed to provide for voting for or against the | ||
| proposition: "The constitutional amendment prohibiting persons | ||
| under the legal drinking age from being employed by or entering a | ||
| liquor store." | ||
