A JOINT RESOLUTION
  proposing a constitutional amendment denying bail to certain
  persons who are unlawfully present in the United States and are
  taken into custody for committing a felony.
         BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article I, Texas Constitution, is amended by
  adding Section 11d to read as follows:
         Sec. 11d.  A person taken into custody for committing a
  felony shall be denied release on bail pending trial if a judge or
  magistrate, following a hearing, determines that the person is not
  a citizen or national of the United States and is not lawfully
  present in the United States.
         SECTION 2.  This proposed constitutional amendment shall be
  submitted to the voters at an election to be held November 5, 2013.
  The ballot shall be printed to provide for voting for or against the
  proposition: "The constitutional amendment denying bail to certain
  persons who are unlawfully present in the United States and are
  taken into custody for committing a felony."
