| proposing a constitutional amendment relating to the right to hunt | ||
| and fish in accordance with state law. | ||
| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article I, Texas Constitution, is amended by | ||
| adding Section 34 to read as follows: | ||
| Sec. 34. (a) Every person has the right to hunt and fish in | ||
| accordance with the laws of this state. | ||
| (b) The right to hunt and fish does not: | ||
| (1) create a right to trespass on private property; | ||
| (2) diminish a right of another person; or | ||
| (3) diminish the duty of the state to manage wild | ||
| birds, fish, and game in a manner that ensures sustainable | ||
| populations of those animals. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 5, 2013. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment recognizing the right | ||
| of a person to hunt and fish in accordance with state law." | ||
