HOUSE CONCURRENT RESOLUTION
WHEREAS, The National Childhood Vaccine Injury Act of 1986
has allowed vaccine manufacturers to operate with impunity,
shielded from accountability, while American taxpayers ultimately
pay the price for injuries caused by their products; and
WHEREAS, The NCVIA has shielded vaccine manufacturers from
any and all liability for injuries and deaths resulting from the use
of their products; and
WHEREAS, Enacted on November 14, 1986, the NCVIA has
prevented millions of vaccine-injured individuals from having
their claims heard by a jury of their peers and has denied them
their state and federal constitutional rights of due process; and
WHEREAS, The NCVIA has caused disparities between vaccine
research, other forms of medical research, and the testing of
medical drugs; knowing that they are shielded from claims of
vaccine injury and death, vaccine manufacturers have no incentive
to test their products as rigorously as do manufacturers of other
medical drugs; now, therefore, be it
RESOLVED, That the 88th Legislature of the State of Texas
respectfully urge the United States Congress to repeal the National
Childhood Vaccine Injury Act of 1986; and, be it further
RESOLVED, That the Texas secretary of state forward official
copies of this resolution to the president of the United States, to
the president of the Senate and the speaker of the House of
Representatives of the United States Congress, and to all the
members of the Texas delegation to Congress with the request that
this resolution be officially entered in the Congressional Record
as a memorial to the Congress of the United States of America.
