| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter I, Chapter 21, Education Code, is | ||
| amended by adding Section 21.416 to read as follows: | ||
| Sec. 21.416. VOTER APPROVAL REQUIRED FOR SUPERINTENDENT | ||
| SALARY INCREASE. (a) The board of trustees of a school district | ||
| may not increase the salary of the district superintendent unless a | ||
| majority of the voters in the district voting in an election approve | ||
| the increase. | ||
| (b) The board of trustees of a school district that proposes | ||
| a salary increase for the district superintendent shall order that | ||
| an appropriate proposition be placed on the ballot at the first | ||
| regular election of trustees held after the date the board proposes | ||
| the increase. The proposition must specify the amount of the | ||
| proposed salary and the proposed percentage increase. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2013. | ||
