relating to the offense of manslaughter; increasing the penalty for | ||
certain offenders. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 19.04(b), Penal Code, is amended to read | ||
as follows: | ||
(b) An offense under this section is a felony of the second | ||
degree, except that an offense is a felony of the first degree if: | ||
(1) the actor delivered a controlled substance to the | ||
individual in violation of Chapter 481, Health and Safety Code; | ||
(2) the individual consumed the controlled substance | ||
without altering the substance; and | ||
(3) the individual's death resulted from the | ||
consumption of the controlled substance. | ||
SECTION 2. The change in law made by this Act applies only | ||
to an offense committed on or after the effective date of this Act. | ||
An offense committed before the effective date of this Act is | ||
governed by the law in effect on the date the offense was committed, | ||
and the former law is continued in effect for that purpose. For | ||
purposes of this section, an offense was committed before the | ||
effective date of this Act if any element of the offense was | ||
committed before that date. | ||
SECTION 3. This Act takes effect September 1, 2015. |
