| relating to a minimum balance prerequisite for the collection by | ||
| mail of unpaid highway tolls and administrative fees. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 372, Transportation Code, | ||
| is amended by adding Section 372.054 to read as follows: | ||
| Sec. 372.054. MINIMUM BALANCE FOR COLLECTION BY MAIL OF | ||
| TOLLS AND ADMINISTRATIVE FEES. Notwithstanding Sections | ||
| 228.0545(c), 228.055(b), 284.0701(b), 366.178(b-2), and | ||
| 370.177(c), a toll project entity may not: | ||
| (1) send an invoice, notice of nonpayment, or other | ||
| communication requiring the payment of an unpaid toll incurred by a | ||
| vehicle or an administrative fee associated with that unpaid toll | ||
| unless the total amount of unpaid tolls owed for the vehicle is $10 | ||
| or more in a calendar year; or | ||
| (2) increase the amount of an administrative fee or | ||
| impose an additional fee for an unpaid toll in the period before a | ||
| communication requiring payment of the toll is sent. | ||
| SECTION 2. This Act takes effect September 1, 2017. | ||
