A BILL TO BE ENTITLED
 
AN ACT
  relating to a minimum balance prerequisite for the collection by
  mail of unpaid highway tolls and administrative fees.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 372, Transportation Code,
  is amended by adding Section 372.054 to read as follows:
         Sec. 372.054.  MINIMUM BALANCE FOR COLLECTION BY MAIL OF
  TOLLS AND ADMINISTRATIVE FEES. Notwithstanding Sections
  228.0545(c), 228.055(b), 284.0701(b), 366.178(b-2), and
  370.177(c), a toll project entity may not:
               (1)  send an invoice, notice of nonpayment, or other
  communication requiring the payment of an unpaid toll incurred by a
  vehicle or an administrative fee associated with that unpaid toll
  unless the total amount of unpaid tolls owed for the vehicle is $10
  or more in a calendar year; or
               (2)  increase the amount of an administrative fee or
  impose an additional fee for an unpaid toll in the period before a
  communication requiring payment of the toll is sent.
         SECTION 2.  This Act takes effect September 1, 2017.
