| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. The heading to Subchapter E, Chapter 228, | ||
| Transportation Code, is amended to read as follows: | ||
| SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL | ||
| COLLECTION, AND [ |
||
| SECTION 2. Subchapter E, Chapter 228, Transportation Code, | ||
| is amended by adding Section 228.202 to read as follows: | ||
| Sec. 228.202. TOLLS PROHIBITED ON PORTIONS OF STATE HIGHWAY | ||
| 146 AND STATE HIGHWAY 99. The department may not charge a toll, | ||
| either directly or indirectly through an agreement with another | ||
| entity, on: | ||
| (1) the portion of State Highway 146 that crosses the | ||
| Houston Ship Channel; or | ||
| (2) the portion of State Highway 99 between its | ||
| intersection with State Highway 146 and its crossing of Cedar | ||
| Bayou. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
