A BILL TO BE ENTITLED
AN ACT
relating to the intercollegiate athletics fee at Prairie View A&M
University; authorizing an increase in the fee.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Sections 54.5393(a) and (b), Education Code, are
amended to read as follows:
(a) The board of regents of The Texas A&M University System
may impose an intercollegiate athletics fee on each student
enrolled at Prairie View A&M University in an amount not to exceed
$12.60 [$10] per semester credit hour, unless the amount is
increased as provided by Subsection (b).
(b) The amount of the fee per semester credit hour may be
increased from one academic year to the next if:
(1) the increase is approved by a majority vote of the
students participating in a general student election held at the
university for that purpose; or
(2) the amount of the increase does not exceed five
percent and is approved by a majority vote of the legislative body
of the student government of the university [imposed on a student in
a semester or session may not exceed the amount of the fee imposed
on a student enrolled in 15 semester credit hours during the same
semester or session].
SECTION 2. Section 54.5393(f), Education Code, is repealed.
SECTION 3. The change in law made by this Act by amending
Section 54.5393, Education Code, applies only to a fee imposed for a
semester that begins on or after the effective date of this Act.
SECTION 4. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2013.
