A BILL TO BE ENTITLED
 
AN ACT
  relating to the creation of an offense prohibiting certain
  transactions involving malt liquor containing certain stimulants.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 101, Alcoholic Beverage
  Code, is amended by adding Section 101.651 to read as follows:
         Sec. 101.651.  CERTAIN STIMULANTS PROHIBITED. (a)  Except
  as provided by this section, a person may not manufacture, import,
  sell, or possess for the purpose of sale malt liquor in a sealed
  container that contains caffeine, ginseng, taurine, or guarana as
  an added ingredient.
         (b)  This section does not apply to malt liquor that contains
  caffeine that is a natural constituent of an ingredient other than
  an ingredient listed in Subsection (a).
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
